OPEN RUNS Terms of Service

Welcome to Open Runs.
These Terms of Use (“Terms”) govern your access to and use of the Open Runs mobile application, website, and related services.
By creating an account, accessing, or using Open Runs, you agree to these Terms. If you do not agree to these Terms, do not use Open Runs.
1. ELIGIBILITY
Open Runs is intended for users who are at least 13 years old.
By creating an account or using Open Runs, you represent that:
• You are at least 13 years old
• The information you provide is accurate and complete
• You have the legal capacity to agree to these Terms
If you are under the age of majority where you live, you should review these Terms with a parent or legal guardian.
2. USER ACCOUNTS
You may be required to create an account to access certain Open Runs features.
You are responsible for:
• Maintaining the confidentiality of your login credentials
• Providing accurate account and profile information
• Keeping your account information current
• All activity that occurs through your account
You may not share your account, impersonate another person, create a misleading profile, or access another user’s account without permission.
We may require email verification or other reasonable steps to confirm account ownership.
You must notify us promptly if you believe your account has been accessed without authorization.
3. USER CONTENT, CONDUCT, AND ZERO-TOLERANCE POLICY
Open Runs allows users to create profiles, create and host runs, join runs, upload photos, send messages, post comments, participate in badge features, and interact with other users.
You are solely responsible for the content you submit and for your conduct while using Open Runs.
Open Runs has zero tolerance for objectionable content or abusive users and behavior.
You agree not to:
• Post false, misleading, fraudulent, or deceptive information
• Harass, threaten, intimidate, stalk, bully, abuse, or endanger another person
• Post unlawful, hateful, discriminatory, obscene, violent, sexually explicit, threatening, abusive, or otherwise objectionable or inappropriate content
• Engage in hate speech or target another person or group based on protected characteristics
• Impersonate another person or misrepresent your identity, affiliation, skills, or authority
• Use Open Runs to spam, scam, solicit money improperly, or promote unauthorized commercial activity
• Upload content that infringes another person’s copyright, trademark, privacy, publicity, or other rights
• Attempt to gain unauthorized access to accounts, systems, data, or app features
• Use bots, scraping tools, automated systems, or other methods to interfere with or extract data from Open Runs
• Interfere with the security, operation, or availability of Open Runs
• Encourage or assist another person in violating these Terms
Users may report objectionable content or conduct through the reporting tools provided within Open Runs. Users may also block other users where blocking functionality is available.
Open Runs may review reported content or conduct and may, at its discretion, remove objectionable content, restrict features, suspend or terminate accounts, or take other appropriate action against users who violate these Terms.
Open Runs reserves the right to take action when we reasonably believe content or conduct violates these Terms, creates a safety risk, harms another user, constitutes abusive behavior, or interferes with the safe operation of Open Runs.
By creating an account and using Open Runs’ interactive features, you agree to comply with this zero-tolerance policy regarding objectionable content and abusive behavior.
4. VENUE AND RUN-POSTING RULES
Open Runs is not affiliated with, endorsed by, or sponsored by any gym, park, school, recreation center, league, business, property owner, or venue listed in the app unless expressly stated.
Users are solely responsible for confirming that they have permission to create, organize, advertise, or host a run at a particular location.
You may not post or host runs:
• At private residences
• On restricted or unauthorized property
• At locations where organized play, solicitation, or group meetups are prohibited
• In violation of posted rules, permits, schedules, reservations, or venue policies
• In a way that blocks access, disrupts lawful activity, damages property, or creates an unreasonable safety risk
Hosts are responsible for providing accurate run details, including the sport, time, location, and any relevant participation requirements.
Open Runs may remove any run or listing that appears unauthorized, misleading, unsafe, unlawful, or inconsistent with venue rules.
Venue owners, property managers, or authorized representatives may request review or removal of a listing by contacting:
5. PARTICIPATION AND HOST RESPONSIBILITIES
Hosts and participants are responsible for their own conduct and decisions.
Hosts are responsible for:
• Providing accurate run information
• Following venue rules and applicable laws
• Communicating material changes or cancellations when reasonably possible
• Avoiding misleading claims about access, reservations, equipment, supervision, or skill level
Participants are responsible for:
• Deciding whether a run is appropriate for them
• Arriving prepared and following venue rules
• Respecting hosts, participants, staff, property owners, and the public
• Using appropriate judgment regarding health, skill level, equipment, weather, transportation, and personal safety
Locking in or joining a run does not guarantee participation, playing time, admission, available space, equipment, or that the run will occur as described.
6. SAFETY AND ASSUMPTION OF RISK
Open Runs provides a platform that helps users discover, organize, and participate in pickup sports activities.
Open Runs does not:
• Organize or supervise every run
• Verify every user’s identity, background, skill level, health, or conduct
• Inspect or approve venues
• Provide medical supervision, coaching, officiating, security, equipment, or transportation
• Guarantee the safety, legality, quality, availability, accuracy, or suitability of any run, host, participant, venue, or location
Sports and in-person meetups involve inherent risks, including physical injury, illness, property damage, collisions, falls, unsafe conditions, weather exposure, and interactions with other people.
You voluntarily assume the risks associated with:
• Using Open Runs
• Attending, hosting, or participating in a run
• Traveling to or from a run
• Interacting with other users
• Using any venue, equipment, or property connected with a run
You are responsible for evaluating your own physical condition, skill level, equipment, surroundings, and ability to participate safely.
Seek appropriate medical advice before participating if you have health concerns or limitations.
7. USER INTERACTIONS
You are solely responsible for your interactions with other users.
Use reasonable caution when communicating with or meeting people through Open Runs.
Open Runs does not guarantee the identity, intentions, conduct, statements, or background of any user.
We may review reports and take action where appropriate, but we are not responsible for monitoring every interaction or preventing every harmful act.
8. REPORTING AND ENFORCEMENT
Users may report content, runs, or conduct that they believe violates these Terms or creates a safety concern.
Reports may be submitted through available in-app tools or by contacting:
We may investigate reports, request additional information, remove content, restrict access, suspend accounts, terminate accounts, or refer matters to appropriate authorities when we believe it is reasonably necessary.
We are not required to disclose details of an investigation or enforcement decision.
9. LICENSE TO USER CONTENT
You retain ownership of content you submit to Open Runs.
By submitting content, you grant Open Runs a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to host, store, reproduce, display, distribute, adapt, and use that content only as reasonably necessary to:
• Operate and provide Open Runs
• Display content to users as intended by app features
• Maintain, secure, troubleshoot, and improve the service
• Review reports and enforce these Terms
• Comply with legal obligations
This license ends when your content is deleted from our active systems, except where retention is reasonably necessary for backups, shared features, legal compliance, security, fraud prevention, or dispute resolution.
10. INTELLECTUAL PROPERTY
The Open Runs name, app, logo, branding, design, text, software, features, graphics, and related materials are owned by Open Runs or its licensors and are protected by applicable intellectual property laws.
Except as expressly permitted by law or in writing, you may not:
• Copy, reproduce, distribute, sell, license, or publicly display Open Runs materials
• Modify, translate, reverse engineer, decompile, or attempt to extract source code
• Remove copyright, trademark, or proprietary notices
• Use Open Runs branding in a way that suggests sponsorship, endorsement, or affiliation without permission
These Terms do not grant you ownership of any Open Runs intellectual property.
11. THIRD-PARTY SERVICES AND LINKS
Open Runs may rely on or link to third-party services, including authentication, maps, hosting, storage, analytics, email, app stores, social media, and other tools.
Third-party services are governed by their own terms and privacy policies.
Open Runs is not responsible for the availability, accuracy, security, content, or practices of third-party services that we do not control.
12. ACCOUNT DELETION, SUSPENSION, AND TERMINATION
You may request deletion of your account through the account-deletion feature available within the app.

We may suspend, restrict, disable, or terminate your access to Open Runs if we reasonably believe that you:
• Violated these Terms
• Created a safety, legal, security, or reputational risk
• Engaged in fraudulent, abusive, threatening, or unlawful activity
• Misused the app or interfered with its operation
• Repeatedly violated venue rules or the rights of others
We may remove content or accounts without advance notice where reasonably necessary to protect users, Open Runs, venues, property owners, or the public.
Sections that by their nature should survive termination will remain in effect, including intellectual property, disclaimers, limitation of liability, indemnification, and dispute provisions.
13. DISCLAIMERS
TO THE FULLEST EXTENT PERMITTED BY LAW, OPEN RUNS AND ITS SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
OPEN RUNS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND QUIET ENJOYMENT.
WE DO NOT WARRANT THAT:
• OPEN RUNS WILL ALWAYS BE AVAILABLE, SECURE, OR ERROR-FREE
• RUN INFORMATION WILL BE ACCURATE OR COMPLETE
• A RUN WILL OCCUR AS POSTED
• A HOST OR PARTICIPANT WILL ACT APPROPRIATELY
• A VENUE WILL BE AVAILABLE OR AUTHORIZED
• DEFECTS OR ERRORS WILL ALWAYS BE CORRECTED
Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
14. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, OPEN RUNS AND ITS OWNERS, OPERATORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
THIS INCLUDES DAMAGES ARISING FROM OR RELATED TO:
• USE OF OR INABILITY TO USE OPEN RUNS
• ATTENDANCE AT OR PARTICIPATION IN A RUN
• INJURY, ILLNESS, DEATH, PROPERTY DAMAGE, OR LOSS
• INTERACTIONS WITH HOSTS, PARTICIPANTS, VENUES, OR OTHER USERS
• RELIANCE ON USER CONTENT OR RUN INFORMATION
• LOSS OF DATA, PROFITS, GOODWILL, REPUTATION, OR BUSINESS OPPORTUNITY
• UNAUTHORIZED ACCESS TO OR USE OF YOUR ACCOUNT OR INFORMATION
TO THE FULLEST EXTENT PERMITTED BY LAW, OPEN RUNS’ TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF:
• THE AMOUNT YOU PAID TO OPEN RUNS DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR
• ONE HUNDRED U.S. DOLLARS ($100)
Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.
15. INDEMNIFICATION
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Open Runs and its owners, operators, affiliates, service providers, employees, and agents from claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising from or related to:
• Your use of Open Runs
• Your content
• A run you create, host, promote, or attend
• Your interactions with another person
• Your violation of these Terms
• Your violation of law, venue rules, or another person’s rights
16. GOVERNING LAW
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Any dispute that is not required to be handled in another manner by applicable law will be brought in a state or federal court located in California, and you consent to the jurisdiction of those courts.
Nothing in this section limits any consumer rights that cannot legally be waived.
17. CHANGES TO THESE TERMS
We may update these Terms from time to time as Open Runs develops or as legal and operational requirements change.
When changes are made, we will update the effective date at the top of this page.
We may provide additional notice when appropriate.
Your continued use of Open Runs after updated Terms become effective means you accept the revised Terms.
18. SEVERABILITY
If any provision of these Terms is found invalid, unlawful, or unenforceable, the remaining provisions will remain in effect.
The invalid provision will be interpreted or modified to the minimum extent necessary to make it enforceable where permitted by law.
19. ENTIRE AGREEMENT
These Terms, together with the Open Runs Privacy Policy and any additional policies or guidelines made available through the service, form the entire agreement between you and Open Runs regarding your use of the service.
